Welcome to Joblendar! By accessing or using our services (including registering an account, creating vacancies, booking slots, or browsing the website), you agree to be bound by these terms. Please read them carefully.

1. User Categories

Our terms apply differently based on how you interact with the service:

  • Customers: Registered users (Candidates and HR/Recruiters) who manage their dashboards, configure availability grids, and track vacancies.
  • Participants: Candidates who access public booking links shared by HR/Recruiters and book slots without registering an account.
  • Visitors: Users who browse public marketing pages of our website.

2. Acceptable Use Policy (AUP)

You agree to use the service only for legitimate job search and recruiting purposes. You are strictly prohibited from:

  • Using automated scripts, bots, or scrapers to generate bookings or lock out a host's availability grid.
  • Using candidate contact details to send unsolicited bulk communications (spam) or violating telephone consumer protection laws (such as TCPA in the US).
  • Uploading resumes or files containing malware, viruses, or illegal materials.
  • Using fake names, emails, or phone numbers when booking an interview slot.

3. Subscriptions & Billing (for HR Customers)

HR/Recruiter accounts can purchase paid subscriptions (Premium/Enterprise) to access advanced features (team booking pools, branding, custom limits):

  • Payments are processed securely via Stripe on a recurring subscription basis (monthly or annually).
  • You can cancel your subscription at any time in your dashboard. Access to premium features will continue until the end of your current billing cycle.
  • Refund Policy: We provide a 14-day money-back guarantee. If you are unsatisfied with your subscription, you may request a full refund within 14 days of your initial purchase or renewal by contacting support. After 14 days, fees are non-refundable except as required by local law.

4. Participant / Guest Booking Terms

By scheduling a meeting via a booking link without logging in (as a Participant):

  • You consent to sharing your name, email, phone number, and uploaded resume with the hosting HR/Recruiter to facilitate the interview process.
  • You consent to receive automated email notifications regarding booking confirmations, updates, video call links, and reminders.
  • You verify that you own all necessary rights to the documents you upload (such as resumes or portfolios).

5. No Automated Decision-Making

Joblendar provides technical tools for evaluating candidates and compiling metrics. The platform does not make any automated decisions regarding candidate rejection or employment. All hiring decisions are made strictly by the employer's personnel (recruiters). We are not responsible for candidate selection outcomes or any claims of hiring discrimination brought against employers.

6. Intellectual Property & DMCA Policy

We respect intellectual property rights. If you believe that content hosted on our platform (logos, job descriptions, or resume files) infringes your copyright, you may submit a formal takedown request to info@joblendar.com. The request must contain a description of the infringement and proof of your ownership.

7. Limitation of Liability

The platform is provided on an 'as is' basis. Joblendar is not liable for any indirect, incidental, or consequential damages, including lost profits, business interruption, loss of candidates, or failed transactions arising from technical failures, server downtime, calendar sync errors, or automated video meeting link generation issues.

8. Age Restrictions (Minors Prohibited)

Use of the Joblendar platform and its services by minors (individuals under 18 years of age or the legal age of majority in your jurisdiction) is strictly prohibited. By registering an account or booking a slot, you warrant that you are of legal age and possess full capacity to enter into binding agreements.

9. Not an Employment Agency

Joblendar operates solely as a provider of scheduling automation and pipeline tracking software (SaaS). We are not an employment agency, staffing firm, recruitment broker, or employer. We do not source jobs for candidates or screen candidates for employers.

10. Accessibility & ADA Compliance

We strive to ensure that our public booking interfaces are accessible in accordance with WCAG 2.1 AA guidelines. HR Customers are independently responsible for ensuring that their custom input content (job descriptions, custom booking instructions) complies with applicable web accessibility laws.

11. Biometric Data & Media Recording

Uploading, recording, storing, or analyzing any biometric data (including voiceprints, facial geometry, or fingerprints) via our platform is strictly prohibited. If you integrate third-party video conferencing services or upload meeting recordings, you agree to obtain prior written consent from candidates in accordance with local biometric privacy laws (such as BIPA in the US).

12. Compliance with Labor & Screening Laws (FCRA & AEDT)

HR Customers agree to comply with all applicable employment, credit reporting (FCRA in the US), and anti-discrimination laws. Joblendar does not act as a consumer reporting agency and does not conduct automated candidate screening or selection. The employer bears sole responsibility for all selection criteria and hiring outcomes.

13. Governing Law, Jurisdiction & Arbitration Agreement (Class Action Waiver)

These Terms and your use of the Joblendar platform shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms, including their validity, invalidity, breach, or termination, shall be referred to and finally resolved by binding, individual arbitration in Montreal, Quebec, Canada, in accordance with the Code of Civil Procedure of Quebec. You and Joblendar agree that each party may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
